Cherkley Court injunction granted by High Court

CAMPAIGNERS battling to stop construction work at Cherkley Court are celebrating after an injunction on the estate was upheld at a High Court hearing on Tuesday. The ruling will last until Wednesday, where it will be decided at another hearing if pressure group the Cherkley Campaign has grounds for a judicial review. Tim Harrold, Chairman of the Cherkley Campaign and vice president of CPRE Surrey, said the ruling left the group in a "satisfactory holding position until we get leave to proceed with our case". Campaigners applied for the injunction to stop "irreversible damage" being done to the site's biodiversity as part of plans by developer Longshot to turn it into a luxury hotel and golf course. A spokeswoman for the Cherkley Campaign told the Advertiser: "The new injunction granted will run until the decision is taken on the judicial review. "The agreed order which was granted today is that no soil stripping is permitted and only a limited area of the Northern Parkland can be treated with herbicide and harrowed. "This pragmatic arrangement is for a period of 8 days and will be reviewed by the court on April 24." Longshot had started the process of turning the grounds golf course but a stop order was issued on March 26, which halted work. The developer has defended its right to apply herbicide, saying it was part of the planning application approved by Mole Valley District Council. The Cherkley Campaign is seeking a judicial review of the council's decision to grant planning permission last year.
